General Terms and Conditions (GTC)

1. Scope of Application

These General Terms and Conditions govern the business relationship between Pout Saver Beauty, Inh. Caroline Ost, Waldweg 14, 24598 Boostedt, Germany (hereinafter referred to as "POUT SAVER BEAUTY", "we", or "us") and the customer (hereinafter referred to as "you" or "the buyer"). Any conflicting or deviating terms and conditions of the buyer shall not be recognized unless expressly agreed to in writing by POUT SAVER BEAUTY.

2. Conclusion of Contract

The presentation of products in our online boutique does not constitute a legally binding offer, but an invitation to place an order. By submitting an order through our website, you make a binding offer to conclude a purchase agreement.

Upon receiving your order, we will send an email confirming its receipt and detailing the order contents. This confirmation solely acknowledges receipt and does not constitute acceptance of your offer. A legally binding purchase agreement is only concluded once we dispatch the ordered products and confirm the shipment via a separate email (Shipping Confirmation). POUT SAVER BEAUTY reserves the right to decline orders at our sole discretion. We do not offer products for purchase to minors and accept no liability for such orders.

3. Right to Cancel within 14 Days (Widerrufsrecht)

You have the right to cancel this contract within 14 days without providing any reason. The cancellation period will expire 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise your right to cancel, you must inform us of your decision by an unequivocal statement (e.g., a letter sent by post or an email). You may use the attached Model Withdrawal Form, although it is not obligatory. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

Please note our strict hygiene policy: As detailed in our Returns & Refunds Policy, cosmetic products are excluded from the right of withdrawal once they have been opened or are no longer in their original, unused condition.

4. Consequences of Cancellation & Return Costs If you cancel this contract, we shall reimburse you all payments received from you for the goods, including the costs of standard outbound delivery, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw. (Please note: If you expressly opted for a type of delivery other than the least expensive standard delivery offered by us, e.g., Express Shipping, we will not reimburse the supplementary costs.) We will carry out such reimbursement using the same means of payment as you used for the initial transaction. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

Return Shipping Costs: You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. You will bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

5. Prices and Payment

Unless explicitly stated otherwise, all prices displayed by POUT SAVER BEAUTY include the statutory European value-added tax (VAT).

You may settle the purchase price via Credit Card, PayPal, or Klarna (Pay Now, Pay Later, or Installments). In cooperation with Klarna Bank AB (publ), your personal data is handled in accordance with applicable data protection laws and Klarna's privacy statement. POUT SAVER BEAUTY reserves the right to exclude specific payment methods in individual cases. In the event of payment default, POUT SAVER BEAUTY is entitled to charge statutory default interest.

6. Shipping and Delivery

Delivery shall be made to the shipping address provided by the buyer. Detailed information regarding complimentary standard shipping, express options, and our Warm Weather Protocol can be found in our Shipping & Delivery Policy. If a delivery fails because the buyer cannot be found at the stated address despite reasonable advance notice, the buyer shall bear the costs for the failed delivery attempt.

7. Retention of Title

The delivered goods shall remain the exclusive property of POUT SAVER BEAUTY until the purchase price has been paid in full.

8. Liability for Defects (Statutory Warranty)

Your rights as a buyer are governed by statutory warranty provisions. If any goods purchased from us prove to be defective, your claims will become statute-barred two years after the delivery of the goods. POUT SAVER BEAUTY shall bear unlimited liability in cases where damages are incurred due to willful intent or gross negligence. Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.

9. Nature of Goods & Ingredient Integrity

POUT SAVER BEAUTY formulations are crafted from premium, unrefined oils and raw butters, processed without heat or chemical solvents to preserve their absolute purity. By purchasing our products, you acknowledge that:

  • Variations: Subtle nuances in texture, aroma, or hue are inherent to the use of authentic, raw botanical ingredients and do not constitute a product defect.

  • Stability: Our treatments respond to environmental changes. Repeated melting and solidifying cycles resulting from improper storage may alter the product's texture.

  • Storage Compliance: Claims for defects are excluded if the product's integrity has been compromised by a failure to follow care instructions (e.g., exposure to direct heat, light, or moisture).

10. Intellectual Property

Our online boutique, brand identity, and all related content—including but not limited to trademarks, text, product designs, displays, images, graphics, and layouts—are the exclusive property of POUT SAVER BEAUTY and are protected by applicable intellectual property laws. You are permitted to use the website for personal, non-commercial purposes only. Any unauthorized reproduction, distribution, modification, or commercial exploitation of our intellectual property is strictly prohibited and will be prosecuted.

11. Governing Law & Legal Venue

These General Terms and Conditions and all contractual relationships shall be governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If the customer is a consumer, this choice of law applies only to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has their habitual residence. The legal venue is Hamburg, to the extent permitted by law.

12. Alternative Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which can be accessed at https://ec.europa.eu/consumers/odr/. POUT SAVER BEAUTY is neither obliged nor willing to participate in dispute settlement proceedings before a consumer arbitration board.
